Abstract :
[fr] La Constitution économique et la Constitution sociale sont toutes deux consubstantiellement liées à la modernité libérale et à l’avènement de l’économie de marché, puis à sa mise en crise par la Question sociale. Dans l'entre-deux-guerres, on observe une convergence de ces deux concepts autour de la revendication d'une démocratisation de l'économie, en particulier au sein de la République de Weimar, sous la plume des juristes sociaux-démocrates. Cependant, après sa réapproriation et sa monopolisation par les néolibéraux, la Constitution économique, centrée désormais sur la sanctuarisation de la concurrence de marché, fut progressivement disjointe et opposée et au constitutionnalisme social, qui eut lui tendance à délaisser la question des structures institutionnelles d'une possible démocratie économique pour se focaliser sur le niveau individuel des droits économiques et sociaux. Il reste que les deux concepts continuent de poser, chacun à leur façon, l'une des questions décisives de la modernité : celle de l’autonomie collective et de son extension, ou non, à tous les domaines du social.
[en] Both the economic and social constitutions are inextricably linked to liberal modernity and the emergence of the market economy, which was later thrown into crisis by the social question. In the inter-war period, a convergence of these two concepts can be observed around the demand for a democratisation of the economy, particularly in the Weimar Republic, as expressed by social democratic jurists. However, after its re-appropriation and monopolisation by the neo-liberals, the economic constitution, now centred on the enshrinement of market competition, was gradually dissociated and opposed to social constitutionalism, which tended to abandon the question of the institutional structures of a possible economic democracy in favour of the individual level, i.e. economic and social rights. Yet both concepts, each in its own way, continue to raise one of the crucial questions of modernity: that of collective autonomy and whether or not it extends to all spheres of society.
