[fr] L’évolution des configurations juridiques de l’économie est régulièrement exprimée sous la forme d’une constitutionnalisation du marché, sorte d’extension de l’État de droit libéral au domaine économique. Pourtant, nombre d’auteurs affirment le recours grandissant à un état d’exception en la matière. Derrière ce paradoxe apparent, c’est en fait la question de la relation ambigüe entre Carl Schmitt et les néolibéraux qui est posée. Loin de la simple filiation, avancée sous les traits du libéralisme autoritaire, c’est en termes de subversion qu’il faut penser un tel lien, ce qui éclaire en retour la dialectique entre constitutionnalisation et état d’exception. [en] The evolution of the legal configurations for the economy is frequently expressed in terms of market constitutionalisation, i.e. the extension of the liberal rule of law to the economic field. Yet many scholars have highlighted the growing use of a state of exception in this area. Behind this apparent paradox lies the issue of the dubious relationship between Carl Schmitt and neoliberalism. Rather than a straightforward filiation, depicted in the form of authoritarian liberalism, such a link must be understood in terms of subversion. This in turn sheds light on the dialectic between constitutionalisation and state of exception.
