Abstract :
[fr] Remettant en cause la catégorisation juridique des individus selon
leur sexe, l’incorporation progressive du concept de genre en droit
annonce un changement dans la conception actuelle du principe d’éga lité. En particulier, la reconnaissance d’un potentiel troisième genre
« neutre » ou « non binaire » fait naître une grande incertitude quant à
l’avenir des actions positives en matière électorale, fondées sur le critère du sexe et visant à remédier à la sous- représentation des femmes
en politique. Entre conservation ou abandon des actions positives au
nom du principe d’égalité, la situation semble inextricable pour les
législateurs belge et français. [en] The progressive incorporation of the concept of gender into law,
which calls into question any legal categorization of individuals
according to their sex, implies a major shift in the current understanding of the principle of equality. In particular, the recognition of a
potential third “neutral” or “non- binary” gender introduces significant
uncertainty regarding the future of gender-based affirmative actions
adopted in electoral law to tackle the persistent under- representation
of women in politics. Caught between preserving or abandoning
affirmative action in pursuit of equality, the situation appears to be a
complex dilemma for legislators in Belgium and France.
