[en] Paris Court of appeals applies EC case law and confirms the sanction imposed for an exchange of information among competitors in an oligopolistic market. In an oligopolistic market, regular exchange of non-public information enables competitors to discover each other’s strategies and violates art. L. 420-1 of the French Code of commerce even in the absence of a cartel on prices or market sharing. Such an exchange of information is in and of itself anticompetitive, as it has the object and effect to suppress uncertainty which is characteristic of the competitive process. [fr] La Cour d’appel de Paris applique la jurisprudence communautaire et confirme la sanction d’un échange d’informations entre concurrents formant un oligopole. Dans un marché ayant une structure oligopolistique, l’échange régulier d’informations non publiques permettant à chacun des concurrents de connaître précisément les stratégie des autres entreprises constitue une infraction à l’article L. 420-1 du code de commerce même lorsqu’elle n’est pas le support d’une entente expresse sur les prix ou d’un partage de clientèle. Un tel échange d’information a en lui-même pour objet et pour effet de supprimer l’incertitude qui caractérise la concurrence.
