[fr] Lorsque le droit s’intéresse aux œuvres d’art, la question de l’auteur est d’emblée placée au centre de ses analyses. Tel est du moins le cas en matière de droit d’auteur et d’annulation de contrats de vente pour erreur sur la substance. Pour déceler dans les œuvres la présence d’un auteur, les juges mobilisent des catégories qui sont avant tout juridiques. Ce faisant, ils n’hésitent pas à aller à l’encontre de l’avis d’experts. La présente contribution aborde succinctement la question de l’originalité en droit d’auteur avant d’examiner une affaire portant sur l’annulation de la vente d’un tableau attribué à David afin de mieux comprendre les rapports qu’entretiennent vérité du droit et vérité de la science. En lisant le monde à travers ses propres catégories, en le purgeant des impuretés qui contrarient sa propre logique, le droit semble bien opérer comme un véritable outil de stabilisation et de hiérarchisation du réel.
[en] When the law takes an interest in works of art, the question of authorship is the initial focus of its analyses. At least this is the case when there are issues of copyright or the cancellation of a sales contract due to an error of substance. To identify the author of a work judges apply categories that are primarily legal. In doing so they do not hesitate to go against the opinion of experts. This article addresses succinctly the question of originality in issues of copyright before examining the case of the concellation of the sale of a painting attributed to David in order to understand better the relationship between legal truth and scientific truth. The law, in reading the world through its own categories and in purging it of the impurities that contradict its own logic, indeed appears to act like a genuine tool of stabilisation and of hierarchisation of the real (transl.
