[fr] Le concept de Constitution économique, s’il fait florès dans la doctrine juridique européenne, ne se situe pas moins également au carrefour d’autres sciences humaines et sociales et possède une riche histoire. Alors que la question de la marge de manœuvre des pouvoirs publics dans le champ économique se pose avec acuité sur l’ensemble du continent, en particulier depuis la crise économique et financière et la récente pandémie mondiale, la présente étude se propose de remettre en perspectives historique et théorique les thèses relatives à la Constitution économique et d’analyser quelques effets et conséquences extra-juridiques du processus actuel de constitutionnalisation de l’ordre de marché. Revenant sur les considérations scientifiques qui ont présidé à l’élaboration de ce projet de recherche collectif, l’introduction vise à expliciter les buts et présupposés de l’ouvrage, à exposer la méthode privilégiée par ses concepteurs, ainsi qu’à présenter sommairement l’ensemble des contributions reprises dans le volume. [en] Now pervasive in EU Law literature, the concept of Economic constitution is also at the crossroads of other social sciences and humanities and carries a rich history. The purpose of the book is therefore to put this controversial notion into historical and theoretical perspective. This contextualisation then sheds new light on the legal and extra-legal issues at stake in the process of constitutionalizing the market order, especially with regard to the key question of states’ room for manoeuvre in the economic field. This last debate has become even more acute since the economic and financial crisis and the recent global pandemic. But first, the analytical framework needs to be clarified. The introduction aims in this respect to retrace the scientific considerations that led to the development of our collective research project, to explain the purposes and assumptions behind it, to set out our interdisciplinary method and, finally, to present briefly all the contributions included in the following pages.
