Abstract :
[en] This webinar discusses the EU Court of Justice’s long-awaited Intel judgment on the treatment of discounts and rebates as an abuse of a dominant position under Article 102. This judgment is of obvious importance for companies trying to design rebate and discount schemes that comply with the EU competition rules. Perhaps more importantly, however, the judgment has far-reaching implications on how Article 102 is applied and, in particular, what importance should be attached to economic analysis as opposed to formulaic legal rules.
