Abstract :
[en] This chapter outlines to what extent the EU damages Directive deviates from or takes into account the requirements of equivalence and effectiveness underlying the principle of national procedural autonomy in EU law. Arguing that the Directive constitutes an operationalisation of those principles, the chapter outlines the strengths and limits of this approach chosen by the EU legislature.
