Abstract :
[en] This article analyses the Court of Justice's willingness to impose clear positive obligations on Member States' legislatures and courts when applying their procedural rules. It argues that those obligations need to be related to the EU principle of effective judicial protection and to the limits incorporated in the case law on that principle.
