Abstract :
[en] This article explores to what extent Article 114 TFEU can still be relied on to establish EU agencies. It argues that it does, yet in doing so, it somehow manages to circumvent long-standing EU doctrines on the establishment and functioning of those agencies outlined in the Meroni judgment. After having outlined the consequences of this, the article looks forward in outlining an approach for the future creation of EU agencies.
