Abstract :
[en] In the framework of an international academic conference on recent developments in internal market law, I analysed the Court of Justice's case law on free movement of capital and privatisations. As Portugal has been one of the returning customers in those kinds of cases, I focused particularly on those Portuguese cases. In my presentation, I analysed to what extent state interventions in the economy would still be tolerated as a matter of EU internal market law, concluding that this is still the case, if and to the extent a public undertaking behaves almost entirely as a private market operator.
