It is a common view that a strict distinction should be maintained between human rights case law and human rights law proper. The authority of human rights norms would be general, while human rights jurisprudence would only consist of the casuistic application of these norms to a specific case. This chapter seeks to nuance this view, with specific reference to the cross-fertilisation phenomenon before the International Criminal Court. It shows that, in its early practice, the permanent ICC has repeatedly relied on human rights case law, not because it was merely choosing to do so, but more particularly, because it considered the relevant findings to be binding as 'internationally recognised human rights' in the meaning of Article 21(3) of the Rome Statute. By focusing on these instances of mandatory reference to the practice of human rights bodies, this chapter also contributes to the existing literature on 'internationally recognised human rights', through an account of the ICC's own perspective on this crucial notion. Au 19e siècle Mackinder définit une dichotomie entre land et sea powers. D’après l’auteur, ces deux entités sont destinées à s’opposer et entrer compétition pour le Heartland, zone de terre étendue et non accessible par la mer. Ce Heartland, situé sur une grande partie du territoire russe et s’étendant en Asie centrale, est actuellement toujours au cœur des tensions entre les grandes puissances. Ainsi des théoriciens tant américains que russes vont reprendre les théories de Mackinder pour analyser mais aussi conseiller la politique étrangère de leurs États. Dès lors, ces auteurs vont appuyer l’importance pour leurs États de maintenir ou reprendre l’hégémonie sur le Heartland. Cet article se penche donc sur l’utilisation, par des académiques contemporains, de la théorie de Mackinder et les recommandations qui en découlent. Nous argumentons que ces recommandations inciteraient les États à émettre des actions qui confirmeraient de facto la théorie et conduiraient dès lors à une escalade de tension entre les États. The WHO (2015) estimates to 1 million deaths par year due to physical inactivity in Europe. The promotion of children physical activity is the starting point as active children are more likely to remain active in adulthood than the others (ACSM et al., 2015). According to ecological model (Booth, 2001) school and teachers are essentials determinants to encourage children in this way. Then, we decided to implement a unit aiming to train physical education students to be able to counselling children and sedentary people. The first step was to interview 15 field professionals supposed to be involved in physical activity promotion in order to identify the essential factors to point out. The second step was to design a formation plan allowing to fill gaps in students skills. The last point will be to implement this formation and to analyse the impact on students actions. [less ▲]

Growth curves of four species of green microalgae have been compared under photoautotrophy, heterotrophy and dim-light-assisted heterotrophy during batch cultivation in small-scale multicultivators equipped with automated optical density acquisition. The results showed that the most relevant biomass productivity parameter (based on Vmax) can be estimated after proper correction of growth curves. For photoautotrophic cultures, Vmax showed no clear relationship to µmax, the specific growth rate measured during exponential phase. Heterotrophic cultures, which are not limited by light penetration, can be characterized by their µmax values, which showed a broad range of values depending more on species than on carbon source (glucose or acetate). Weak light (defined as unable to sustain photoautotrohic growth) had only minor effects on heterotrophic growth in terms of biomass but, for some species, could be used to promote pigment accumulation up to levels comparable to those found under photoautotrophy, as revealed by HPLC analysis. This presentation will focus on both didactic and pedagogical reflections teaching mathematics in architecture programme in order to support the experience and learning of first year students. Led in order to promote the students’ intrinsic motivation (Deci & Ryan, 1985) and support our didactic reflections, an inventory of mathematical difficulties encountered by freshmen in their program has been established. This inventory also served the purpose of demystifying mathematics and valuing them through a place in a cursus more rooted in the profession (Wigfield and Eccles, 2000). Sorted according to the skills involved, the relevant difficulties pointed out by students were mostly found in two courses, topography and structure. Several examples will be presented demonstrating the lack of transfer between the disciplines, students studying formulas without understanding them. To counter this lack of transfer, pedagogical reflections about our current teaching were developed thanks to the Feedback First-Year Project (FFYP) developed in the University of Liège. In this context, three significant devices set up in mathematics were developed. The first one is an online-oriented prerequisite test implemented on our academic online platform. The second one is an intermediate test based on true/false quizzes and the third one a simulation of the real exam with peer interventions. According to Nicol’s recommendations (2009), each of these features is completed with specific feedbacks specially designed in order to impact several dimensions of their motivation. [less ▲]

Purpose: This paper describes the theoretical background and main hypotheses at the basis of SAFIR®, a nonlinear finite element software for modeling structures in fire. The paper also explains how to use the software at its full extent. The discussed numerical modeling principles can be applied with other similar software. Approach: Following a general overview of the organization of the software, the thermal analysis part is explained, with the basic equations and the different possibilities to apply thermal boundary conditions (compartment fire, localized fire, etc.). Next, the mechanical analysis part is detailed, including the time integration procedures and the different types of finite elements: beam, truss, shell, spring and solid. Finally, the material laws are described. The software capabilities and limitations are discussed throughout the paper. Findings: By accommodating multiple types of finite elements and materials, by allowing the user to consider virtually any section type and to input the fire attack in multiple forms, the software SAFIR® is a comprehensive tool for investigating the behavior of structures in the fire situation. Meanwhile, being developed exclusively for its well-defined field of application, it remains relatively easy to use. Value: The paper will improve the knowledge of readers (researchers, designers and authorities) about numerical modeling used in structural fire engineering in general and the capabilities of a particular software largely used in the fire engineering community. En effet, au sein d'une structure fédérale ou régionale, il existe une complexification de la mise en œuvre des mécanismes référendaires. Dans un contexte parfois multinational, il est inapproprié de rechercher la volonté populaire au moyen d’une simple approche majoritaire qui ne renseigne pas suffisamment sur l’existence des différentes communautés sociales et politiques au sein de l'État. L'objectif de la recherche est d'analyser, par le biais du droit comparé, les adaptations qui existent dans certains États. [less ▲]

The non-conventional yeast Yarrowia lipolytica is widely investigated for its unusual metabolic properties. Among them is the ability of Y. lipolytica to adopt an ovoid or hyphal morphology according to environmental conditions. The mechanism of dimorphic transition involves numerous genes, which have been poorly documented to date. Here, we report on the isolation of a filamentous mutant from an insertion mutagenesis library, the subsequent identification of the mutated gene, and the use of this filamentous mutant in biofilm bioreactors. The non-conventional yeast Yarrowia lipolytica is increasingly used for the production of recombinant proteins or biomolecules with biotechnological or pharmaceutical applications. The development of such a cell factory requires steps of genome editing that rely on selectable markers. The recently identified EYK1, encoding erythrulose kinase, can serve as an efficient catabolic selectable marker for genome editing in Y. lipolytica. Besides, the cloning-free strategy developed here simplifies the construction of disruption cassettes for genome editing in Y. lipolytica. [less ▲]

La formation dispensée dans le cadre du cours de Séminaire de recherche consiste en une initiation au métier de sociologue ou du moins à l’une de ses facettes : le soutien à la décision politique, à travers la collecte et l’analyse de données originales. Les étudiants seront invités dans une première étape à ex-plorer collégialement une demande émanant d’un responsable politique local et à la traduire en termes sociologiques (paradigme constructiviste). Dans une deuxième étape, ils devront collecter des informations au cours d’investigations de terrain. Enfin, ils auront à mettre en forme un plan d’intervention destiné à soutenir un choix politique concernant le problème investigué. Le problème retenu est extrait d’une situation réelle, mais il est adapté aux besoins de la formation : son envergure reste limitée et les éléments trop techniques en ont été retirés. [less ▲]

The mechanical behavior of visco-plastic materials such as nickel-based alloys is highly dependent on temperature. Some characteristics such as viscosity, hardening, static recovery, dynamic recovery have more or less influence on the overall behavior depending on the considered temperature. The unified constitutive model developed by Chaboche [1] is very efficient in representing this complexity as it is very adaptable and can contain many features. A basic Chaboche model contains a viscosity law and one or several hardening equations. Within these hardening equations, it is possible to add several features that will represent the complex behavior of the material. The aim of this study is to understand the role of the different parameters and the influence of the different features in an advanced Chaboche model adapted to cyclic anisothermal loading. This specific model was also developed in [2],[3]. However, part of this study is based on particular cases where different features of the model are analyzed [4]–[6]. [less ▲]

La formation dispensée dans le cadre du cours d’Introduction à la démarche sociologique a pour objectifs d’amener les étudiants à porter un « autre » regard sur le monde social et plus particulièrement, sur des situations de la vie quotidienne, de leur apprendre à exercer un regard critique sur la façon dont on parle de ce monde ou la façon dont on le présente. Cet apprentissage suppose d’entretenir une méfiance méthodique à l’égard des propositions de bon sens, des idées toutes faites ou des prises de position idéologique. Cette partie de la formation partira d’exercices basés sur des comptes rendus d’observations de situations de la vie quotidienne, d’une analyse d’un phénomène social (les manières d’être à la plage) et de documents présentant un état des lieux statistiques de ce phénomène social, pour permettre à chacun de s’approprier la notion de « rupture épistémologique ». La réflexion se centrera sur le premier acte de la démarche scientifique identifié dans le Manuel de recherche en sciences sociales de Luc Van Campenhoudt et Raymond Quivy (avec la collaboration de Jacques Marquet) publié chez Dunod en 2011 (4e édition) et apprendra à tirer les conséquences du fait que « lorsque nous abordons l’étude d’un sujet quelconque, notre esprit n’est pas vierge ; il est chargé d’un amoncellement d’images, de croyances, d’aspirations, de schémas d’explication plus ou moins inconscients, de souvenirs d’expériences agréables ou douloureuses, à la fois culturelles et personnelles, qui préformatent notre approche de ce sujet » (Van Campenhoudt et al., 2011, p.18).
